The Tribunal highlights the necessity of management evaluation, quoting Nwuke and Caldarone. It is not enough to merely initiate the procedure. On the contrary, the result of Management evaluation has to be awaited generally, before an application may be submitted to the Tribunal. It is not within the Applicant's discretion to evade management evaluation which is considered useless. Outcome: Application was dismissed.

The application deals with non-promotion. Having been informed about the management evaluation procedure the Applicant wrote to the Secretary-General, who told her to address· the Deputy High Commissioner, UNHCR, to whom the management evaluation for UNHCR Staff members had been delegated. The Applicant declines to continue with the procedure because she has no confidence in UNHCR institutions. Although judicial recommendations were given to the applicant, she did not respond.
