The contested decision did not affect the applicant’s terms of appointment derived from his status as a former staff member or from his status as a retiree. Furthermore, there is not a contractual relationship between the applicant and the Organization derived from his voluntary service as a member of the Panel of Counsel. The application was thus neither receivable before the UNAT nor before the UNDT. Outcome: The application was rejected.

The application deals with the decision taken by UNOV to restrict the applicant’s access to the Vienna International Centre (VIC) to entry for pre-arranged appointments if accompanied by the staff member with whom he had the appointment. At the time the decision was taken, the applicant was a retired UN staff member and he was member of the Panel of Counsel. In February 2007, the applicant filed an appeal before the former UNAT; his case was transferred to the UNDT in January 2010.
